New Mexico Statute (Chapter 61; Article 32; Section 19) indicates the person(s) empowered to authorize this cremation. If the children, parents and guardians, or siblings are the highest next of kin, a majority of the class whose whereabouts are reasonably ascertainable are needed to authorize (for example: if 4 children, 3 must authorize). If a majority cannot agree, or the rights of authorization are unclear, any party may petition the Probate Court for judicial review. It is the policy of Rivera Family Funeral Homes to ensure that at least one of the authorizing methods is used for cremation to proceed. Therefore, I/we, the undersigned, hereby certify that I/we are the closest survivors and/or possess the highest right to make the disposition of the deceased according to the laws of the State of New Mexico. In addition, I/we represent that there is no objection to this cremation, nor is there any objection to the release and final disposition of the cremated remains, by anyone with legal standing, including a spouse, adult children, parents, or adult siblings of the deceased. Separate authorization(s), if necessary, shall be attached to and considered a part of this form.

The "Authorization for Cremation" form will be emailed to each of the authorizing agents for whom an email address was provided. Each agent must sign the form and have it notarized, before faxing to us (505-753-5500) or scanning the document and emailing it back to us at customercare@cremationsnm.com.

If any of the authorizing agents listed do not have email accounts listed, you must get the form to them for signature and return it to us (you can go to the previous form part to fill in email addresses now, if you failed to do so because they were not required).
